Legal
The rules that govern how you use our site, and how we work together when you engage us.
These Terms and Conditions (the “Terms”) govern your use of https://ateliernz.co/ (the “Site”), owned and operated by C&I Atelier. The Site is a professional services website. By using the Site, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not use the Site.
About the Studio
C&I Atelier is a multidisciplinary design studio rooted in Taranaki, Aotearoa New Zealand. We help local businesses, property developers, construction firms, and design professionals with websites, e-commerce, UX/UI consulting, branding and graphics, architectural visualisation, virtual assistant and digital support, and ongoing hosting and care plans.
We are a services studio. Nothing on this Site constitutes a quote, an offer, or a binding agreement to provide services. Engagements are confirmed separately, in writing, following a scoping conversation.
Intellectual Property
All content published and made available on the Site is the property of C&I Atelier and the Site’s creators. This includes, but is not limited to, images, text, logos, documents, downloadable files, and anything that contributes to the composition of the Site.
You may not reproduce, distribute, modify, or republish any part of the Site without our prior written permission. Intellectual property in client deliverables is handled separately and is set out in each engagement agreement.
Acceptable Use
As a user of the Site, you agree to use it lawfully and respectfully. You agree not to:
- Harass or mistreat other users of the Site;
- Violate the rights of other users of the Site;
- Violate the intellectual property rights of the Site owners or any third party to the Site;
- Act in any way that could be considered fraudulent; or
- Send spam, unsolicited communications, or any form of unauthorised promotional material.
If we believe you are using the Site illegally or in a manner that violates these Terms, we reserve the right to limit, suspend, or terminate your access to the Site. We also reserve the right to take any legal steps necessary to prevent you from accessing the Site.
Services, Quotes & Scope
We offer our services in three published tiers — Starter (Web Presence), Growth (Business Website), and Care (Studio Plan) — alongside custom-quoted work such as architectural visualisation, branding, and retainers. All pricing is in NZD.
Published tiers are indicative, not binding. Every engagement is confirmed by a written quote or proposal that sets out the scope, timeline, deliverables, and fees for your specific project. Where a published tier and a written quote differ, the written quote prevails.
What each tier includes
Starter
Web Presence
Up to 5 pages, mobile-responsive; contact form and map integration; basic SEO setup; 30-day post-launch support.
Growth
Business Website
Everything in Starter, plus: up to 10 pages with CMS support; brand and e-commerce ready; analytics setup; 60-day post-launch support.
Care
Studio Plan
Recurring monthly plan covering security, backups and monitoring; monthly edits and content updates; priority support and an annual refresh; performance and uptime reporting.
Scope and professional boundaries
In the interest of transparency, we are explicit about what we do and do not provide. C&I Atelier provides architectural design support, visualisation, and drafting support. We do not provide regulated architectural services, and we do not act as a Licensed Building Practitioner (LBP) unless an appropriately licensed professional is engaged separately as part of your project.
If your project requires regulated architectural or building work, we will tell you clearly and, where possible, help you identify the right professional.
Fees and payment
Fees, deposits, milestones, and payment terms are set out in each written quote or engagement agreement. Recurring plans (such as the Care tier) are billed on a monthly basis and continue until cancelled in accordance with the terms of that plan. Late or unpaid invoices may result in suspension of services.
Client responsibilities
To keep projects on track, we rely on you to provide content, approvals, access, and feedback in a timely manner. Delays caused by outstanding client input may affect timelines and, in some cases, fees.
Intellectual property in deliverables
Ownership of final deliverables transfers to you once your account is paid in full, unless otherwise agreed in writing. We retain ownership of our working files, internal tools, reusable components, and code libraries. Third-party assets (such as fonts, stock imagery, and plugins) remain subject to their own licences.
Hosting and ongoing support
Where we provide hosting or a care plan, we will maintain your site with reasonable care and skill. No hosting provider can guarantee uninterrupted uptime, and our care plans do not cover issues caused by third-party services, client-made changes, or events outside our reasonable control. On termination of a care plan, we will work with you on an orderly handover.
Links to Other Websites
The Site may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party website or service linked to on the Site. It is your responsibility to read the terms and conditions and privacy policies of those third-party websites before using them.
Limitation of Liability
C&I Atelier and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses, including legal fees, arising from your use of the Site.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under New Zealand law, including under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 where those Acts apply.
Indemnity
Except where prohibited by law, by using the Site you indemnify and hold harmless C&I Atelier and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses, including legal fees, arising out of your use of the Site or your violation of these Terms.
Applicable Law
These Terms are governed by the laws of New Zealand. Any dispute arising in connection with the Site or these Terms will be subject to the exclusive jurisdiction of the New Zealand courts.
Severability
If at any time any provision of these Terms is found to be inconsistent or invalid under applicable law, that provision will be deemed void and removed. All other provisions will not be affected, and the rest of these Terms will remain valid and enforceable.
Changes to These Terms
